Donations tax-deductable

Post by flaviut »

The wiki states that donations through Open Collective are tax deductable in the USA, but this isn't correct: from https://opencollective.com/freecad/donate, FAQ -> "Does Open Source Collective have a contribution policy?"

> Contributions to Open Source Collective are not tax deductible in the U.S. While OSC is a non-profit, it is a 501(c)(6) not a 501(c)(3).

Can someone please update the wiki page at https://wiki.freecad.org/Donate? Looks like it's (correctly) locked down.

Probably not because the German tax authorities apply strict rules here. Just search the Web for "deutsches finanzamt anerkennung von spende an ausländische NGO" to get pretty decent information.

Still, I believe it is not a crime to submit your donation to the tax authorities without further comment and then wait and see if they accept/reject it.

If it's the same as in Belgium, you cannot pretend to a tax reduction just by donating to anyone. It must be a "charity" org, and the charity status is something only given to a very defined list of org types like hospitals, philantropic NGOs, etc, which we are not. And to pretend to tax reduction, you need a special kind of receipt that this org gives you.

Just to add to this. In Germany it is like this I believe: If an organization has charity status in another country, the German tax authorities do not care about this foreign status at all. You have to prove to them that the organization has a legal structure that basically makes it equivalent to a German entity with charity status. This proof is probably difficult, time-consuming, costly and practically impossible to make... This also holds if the non-German organization is located in the EU. Bummer!

Interesting idea! So, perhaps one could set-up a German-registered "club" (e.V.) that can receive tax-deductable donations in Germany and then the club could funnel the donation to FPA!? (A tax advisor would have to check the German tax code if this is actually possible.)
